Terms of Service

These Terms explain the rules for using Make3DMap—from creating terrain scenes and uploading assets to working with AI, publishing maps, embedding them and exporting files.

Agreement to these Terms

These Terms of Service form a binding agreement between you and Holymolly Ltd (collectively with its affiliates, “Make3DMap,” “Tripo,” “we,” “us,” or “our”) regarding your use of the Make3DMap website, applications, APIs and related services (the “Service”).

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you use the Service for an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.

Eligibility and accounts

You must be at least 13 years old, meet the minimum digital-consent age where you live, or use the Service with permission from a parent or legal guardian. You must provide accurate account information and keep it current.

You are responsible for activity performed through your account and for protecting your sign-in credentials. Tell us promptly at support@tripo3d.ai if you believe your account has been accessed without authorization.

The Service

Make3DMap lets you select real-world terrain, create and edit 3D scenes, add routes, labels, markers and assets, use AI-assisted tools, publish or embed maps, remix public scenes, and export supported files. Some features require an account or depend on third-party services.

We may add, change, limit, suspend or discontinue features. We do not promise that any feature, content, upload, share URL, embed or export will remain available forever. Keep your own copies of content that is important to you.

Your content and permissions

You remain responsible for the text, prompts, map data, routes, images, textures, 3D models and other materials you submit to the Service (“Your Content”). You represent that you have the rights and permissions needed to submit and use Your Content.

You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, format, display and technically modify Your Content only as reasonably needed to operate, secure, improve and provide the Service according to your actions and visibility choices.

If you make a map public, you also permit us to display and distribute it through public share pages, community listings and embeds. Public maps may be viewed, shared and remixed by others. A remix creates an independent copy and does not change your original map.

AI features and generated content

Some features use artificial intelligence and third-party generation or search services. AI results may be inaccurate, incomplete, unsafe, offensive, non-unique or unsuitable for your intended use. They may also misrepresent real places, people or facts.

You are responsible for reviewing outputs before using, publishing or exporting them and for ensuring that your use complies with law and third-party rights. AI output is not professional, legal, safety, surveying, navigation or engineering advice.

Features that connect to Tripo or another provider may also be governed by that provider’s terms. Those terms control your use of that third-party feature.

Acceptable use

You may not use the Service to:

  • break the law or violate another person’s intellectual-property, privacy or other rights;
  • upload malware, harmful code or content you do not have permission to use;
  • harass, deceive, impersonate, exploit or endanger another person;
  • circumvent security, access controls, usage limits or technical restrictions;
  • scrape, crawl, probe, overload or disrupt the Service without our written permission;
  • reverse engineer protected portions of the Service except where applicable law permits it; or
  • use the Service or its output for high-risk decisions where errors could cause injury, loss of life or material property damage.

We may investigate suspected violations and remove content, limit access, suspend accounts or cooperate with lawful requests where appropriate.

Map data, sharing and exports

Terrain, imagery, elevation, place information and other geographic material may come from third-party providers and may be delayed, incomplete or inaccurate. Do not rely on the Service for navigation, emergency response, boundary determination, surveying or other safety-critical uses.

Your right to use an exported file may depend on Your Content, the source data, generated assets and the terms of applicable third-party providers. You are responsible for checking those rights before commercial use, redistribution or publication.

Third-party services

The Service relies on or links to third-party services, including authentication, hosting, storage, mapping, elevation, search and AI providers. We do not control those services and are not responsible for their availability, content or practices. Your use of them may be subject to separate terms and privacy policies.

Our intellectual property

The Service, including its software, interface, branding and original content, is owned by us or our licensors and is protected by intellectual-property laws. These Terms give you a limited, revocable, non-exclusive and non-transferable right to use the Service. They do not transfer ownership of the Service or our trademarks to you.

Suspension and termination

You may stop using the Service at any time. You may request account assistance or deletion by contacting us. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, fail to pay an applicable charge, or if we are required to do so by law.

After termination, you may lose access to maps, uploads, conversations and other account data. Public content may remain available where necessary to preserve remixes, comply with law, resolve disputes or maintain service integrity.

Disclaimers and limitation of liability

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant uninterrupted, secure or error-free operation or the accuracy of any content or output.

To the fullest extent permitted by law, we and our affiliates, officers, employees, agents and providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or business interruption arising from the Service.

Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded.

Indemnity

To the extent permitted by law, you will defend and indemnify Holymolly Ltd and its affiliates from claims, losses and expenses arising from Your Content, your unlawful use of the Service, your violation of these Terms or your violation of another party’s rights.

Governing law and disputes

These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law rules. A dispute arising from these Terms or the Service will be submitted to the Hong Kong International Arbitration Centre for arbitration in Hong Kong under the rules in effect when arbitration begins, unless applicable law gives you a non-waivable right to bring a claim elsewhere.

Changes and contact

We may update these Terms from time to time. We will post the revised version and update the date above. If a change is material, we may provide additional notice. Continued use after the updated Terms take effect means you accept them.
